Tenancy Agreement Review
We have recently completed a review of the four different types of Tenancy Agreements used by the Trust, in order to standardise the Agreements and to ensure equality and consistency for all our tenants.
We consulted tenants at theAnnual Residents conference and the Joint Residents Group to ensure that as many tenants as possible were consulted. Many tenants have told us that they would prefer that the bungalows are tenanted by the over 60’s and this has been incorporated into the new Tenancy.
The aim of the review was to:-
Standardise housing management & practice
Reduce variations
Increase clarity for the Trust and tenants
Reduce complexity of paperwork
Increase efficiency of the Annual Rent review
YOUR TENANCY AGREEMENT-WHAT IS IT
Your Tenancy Agreement is a legal contract between Newport Housing Trust Ltd (your landlord) and you as the tenant. It sets out the legal terms and conditions which you, and the Trust, must adhere to whilst you occupy your bungalow.
Within the Tenancy Agreement it includes the roles and responsibilities of both parties to the agreement, for example:-
Statement of rent & service charges (what you get for your money)
Tenants rights e.g. who can live with you; your right to information
Landlords responsibilities e.g. to keep the property in good repair
Tenants obligations e.g to pay the rent weekly and use of the property
How changes are reviewed
By signing the new Deed of Variationyou are agreeing to vary your existing Agreement. Many of terms and conditions within your original Agreement remain the same, but some of the clauses have been amended. The main benefits are:-
Ensure estates are well balanced and harmonious
Ensures that the bungalows are reserved for the over 60’s only
Ensure that void costs are kept to a minimum
Rent – nothing will change with regard to the weekly rental and service charge or the frequency of any increases or decreases which have already been agreed
Reduce the complexity of paperwork
Equality of service - all tenants will be treated equally
Clarifies certain tenancy conditions – for example the keeping of pets; parking of vehicles and nuisance problems
Clarifies the right to sub-let your bungalow or take in lodgers
You do not have to sign the Deed of Variation, but we would encourage our tenants to do so.
A letter has been sent to all tenants, together with a copy of the new Tenancy Agreement, and the Deed of Variation. You are encouraged to compare the details between your existing Tenancy Agreement and the new Agreement.
If you are happy with the changes you will need to sign the Deed of Variation NOT the Tenancy Agreement.
